Disciplinary Proceedings

This page contains details of recent, current and forthcoming proceedings before the IfL’s Professional Practice and Appeals Committees. IfL are a body with specific duties under statute and as such is expected to be open and transparent in its proceedings. Certain parts of the Disciplinary Procedure Rules (PDF opens in new window) under which the disciplinary Committees operate require that the proceedings are public. For example, Rule 33(a) states:
“A hearing of the [Professional Practice] Committee shall be conducted in public unless, in the interests of justice or some other reason, the Committee directs that all or part of the hearing shall be conducted in private.”
In addition, Article 6(1) of the Human Rights Act 1998 states that:
“In the determination of his civil rights and obligations…, everyone is entitled to a fair and public hearing… Judgement shall be pronounced publicly…”
Article 14(1) of the International Covenant on Civil & Political Rights 1966 (“the ICCPR”) states that:
“…any judgment rendered in a criminal case or in a suit at law shall be made public except where the interest of juvenile persons otherwise requires or the proceedings concern matrimonial disputes or the guardianship of children.”
The European Court of Human Rights has interpreted the requirements of Article 14(1) of the ICCPR as going beyond the requirements of merely announcing any judgement in public to making the judgement available to the public.

Hearings of the Committee are held in public, unless in the interests of justice or for some other reason the Committee directs that all or part of the hearing should be conducted in private. If you are interested in observing a Professional Practice Committee hearing please email us at least 48 hours before the hearing with your name, contact information, which hearing you would like to attend and details of any particular access requirements. Spaces will be allocated on a first come, first served basis.
